ASSISTANCE TO REAL ESTATE AGENTS

Our law firm works hand-in-hand with real estate agents every day to help clients save their homes from foreclosure, understand the short sale process, and make sure that they are well informed on all their real estate options. Because we have such a close working relationships with real estate agents, we are very familiar with the problems that agents face, and have some excellent legal services to assist real estate agents. The following are services that we offer to real estate agents and their clients to improve the success of short sales.

1) Postpone Foreclosure Sale

Over the years of doing loan modification work for clients, our office has developed a good working relationship with most major lenders. We have an excellent working knowledge on how banks function, and the best way to negotiate postponements of foreclosure sale dates. If you have a client with a foreclosure auction pending, and you can’t get the bank to postpone it, all of your hard work is at risk of being lost when you don’t have enough time to close escrow. Our office assists agents in delaying the auction so your commissions are not lost to a foreclosure. Our attorney fees for this work are results-based, meaning your client does not pay unless we actually achieve a postponement of the sale. We can even stop the auction on just a few days’ notice. 2) Prepare Short Sale Hardship Documentation and Track Foreclosure Dates

Preparing short sale hardship applications and tracking client foreclosure sale dates can be time consuming and frustrating. Although our office currently does not do short sale negotiation, we assist agents in the preparation of hardship packages to make sure that your client’s short sale application has the best chance of approval. Our attorneys and experienced real estate staff have helped get hundreds of clients approved for loan modification with our hardship packages. We will assist self-employed clients in creating profit and loss statements, prepare hardship letters, and insure that the application is comprehensive, accurate and 100% complete for your submission to the lender. Spend your time working on new listings and client maintenance, let us handle the paperwork.

3) Explanation of Tax Consequences

Most clients are very concerned about the tax ramifications of major real estate transactions. Our office offers consultations where we conference with a client and their CPA to give the client up-to-date, accurate information about any tax exposure they may have with regard to their real estate transactions.

4) Explanation of Deficiency Debt

You may have already explained to your client that they will not owe a deficiency balance after their short sale, but sometimes they just want to hear it from an attorney! When clients have concerns about debt after a short sale, avoid giving legal advice to them by referring them to our office. Our attorneys will educate clients about the lender’s collection rights after short sale, foreclosure or bankruptcy.

5) Explanation of Foreclosure Prevention Options

Many clients are interested in short sale because they believe that there is no other way to save their house from foreclosure. Our office specializes in making real estate more affordable.
